Greg Baumgartner speaks with us in this article, identifying common contexts for accidents involving electricity and sharing more insights he gained from a successful career as a personal injury attorney.
In your experience as a personal injury attorney, where and under what circumstances are electrical accidents most likely to occur?
Most of the cases we handle involving electrical injuries stem from a construction site or work activity. There is a proportion that occurs in residential settings. However, we have found that construction and maintenance activities are the most vulnerable to electrocution.
Maintenance and general operations seem to be the common thread of electrical injury cases in manufacturing. When a worker comes into contact with live current, it means that someone did not follow the safety rules.
Often times, electrocution is caused by a lockout, an exit sign violation, or workers who are not properly or are not properly trained. We’ve had cases of unlawful killings involving electrocution where the product was faulty. Product cases may include a defective product.
Some of our cases involve electricians who didn’t do the job right and left a dangerous situation.
What injuries can cause contact with an electrical source? What is the typical severity of the cases you see, and how could it change your life?
Most of our cases involved death. Connecting to a power source can easily be fatal. It is usually the lucky one who survives the electrocution. Those who survive can sustain severe injuries from which they take a very long time to recover – if they can recover.
Why is a post-incident investigation so important when it comes to an electrical source, and what are the steps involved?
It is absolutely essential that a preliminary investigation be conducted immediately after a wrongful injury or death incident has occurred. It is required to seek the assistance of a skilled and experienced lawyer in electrocution cases. Most accident investigations will involve expert witnesses who are appointed to determine the cause of the accident and how the injury could have been prevented. Delay in starting the preliminary investigation can damage the case and sometimes even make it impossible to prove the case.
It is absolutely essential that a preliminary investigation be conducted immediately after a wrongful injury or death incident has occurred.
OSHA investigates many workplace injuries, and we believe that hiring your representative to conduct their own investigations is better than relying on others like OSHA.
The family or injury victim must act quickly to preserve vital evidence before it is altered or destroyed.
What factors determine whether an accident causing electrical injury is considered a product liability or a building liability case?
As we mentioned above, one of the most serious violations we find is ignoring or exceeding the requirements to close or place an exit sign.
Almost all shutdowns and shutdowns involve negligence on the part of the company rather than the product’s liability. However, we have had product cases where the electrical supply was not properly grounded, resulting in wrongful death. It is essential to conduct a preliminary investigation quickly after the incident to determine who was responsible and why.
How can an experienced electrical injury lawyer help the injured party obtain the necessary compensation?
As with any personal injury case, getting an experienced attorney who is not educated on the job is important to the client. It is not just about knowing what to do and how to do it, but also having the experience, expert witnesses and approach needed to maximize compensation for the victim or their family.
What is the first piece of advice you would give to someone who has recently been the victim of an electrical accident?
First tip: If your injuries are serious or you lose a loved one, do your homework. Find the best and most experienced personal injury attorneys near you and hire them ASAP.
The delay is in favor of the insurance company. If someone waits too long before they get a lawyer, important evidence may be destroyed, making it difficult or impossible to pursue a case.
