The New Jersey Law Journal reported that the case involved a man who suffered burns covering more than 60% of his body as a result of an electrical panel explosion while the man was working on the electrical system inside an office building in Newark, New Jersey.

The facts of the case as disclosed in the Court Opinion of 24 February 2023 of Essex County Magistrate Her Excellency Sheila Venable revealed that the 2019 explosion caused the worker to catch fire from his knees to his head severely injuring and disfiguring him. . Normally, injured workers are barred from suing their employers and left with only a claim for workers’ compensation, but Davis succeeded in proving that the injured worker, a non-electrician, was improperly directed to remove the protective covering covering several active high-voltage electrical components. This action by the employer was gross negligence enough to allow the injured worker to file a separate claim for damages in the New Jersey Supreme Court.

The explosion occurred while the injured worker was standing on a 6-foot ladder inside a cabinet containing an electrical panel. The electrical blast was so violent that it threw him off his ladder and set him on fire. He ran 60 feet to an office for help, but finding no help, he used a fire extinguisher to put out the flames. With his skin melting away, still smoking and in unimaginable pain, he descended the stairs two floors calling for help, only to collapse and fall unconscious on the bathroom floor.

The injured worker was placed in an artificial coma for six weeks and underwent, in great pain, 166 operations. He may still face 20 more surgeries and a lifetime of care. The $28 million award represents compensation for his pain, suffering, and financial loss. The settlement also included damages for his disfiguring scars, emotional damages and losses including post-traumatic stress disorder. Part of the $28 million was allocated to his wife as compensation for her losses.
